One K (collectively referred to as "One K," "we," "us," or "our") operates as a premier bar and lounge venue, including One K Bar, One K Miami, and One K Room, located at 1000 S Miami Ave, Miami, FL 33130. These Terms of Service ("Terms") govern your access to and use of our website (onekmiami.com), our premises, events, reservations, and any related services (collectively, the "Services"). By visiting our website, making a reservation, attending an event, or entering our premises, you agree to be bound by these Terms. If you do not agree, you must not use our Services.
We reserve the right to modify these Terms at any time. Changes will be posted on our website with the updated effective date, and continued use of our Services after such changes constitutes acceptance. You are responsible for reviewing these Terms periodically.
1. Age Restrictions and Liquor License Compliance
One K operates under a valid Florida liquor license issued by the Florida Division of Alcoholic Beverages and Tobacco (ABT), which permits the sale and service of alcoholic beverages on our premises in accordance with Florida Statutes Chapter 561 and related regulations.
- Age Requirement**: You must be at least 21 years of age to consume alcoholic beverages on our premises. All patrons under 21 years of age are permitted only in designated non-alcohol service areas, if any, and must be accompanied by a parent or legal guardian. We strictly enforce this policy and reserve the right to request valid government-issued identification (e.g., driver's license, passport) upon entry or prior to service. Any misrepresentation of age is a violation of these Terms and Florida law, and may result in immediate removal, denial of service, and potential criminal penalties under Florida Statute § 562.11.
- Responsible Service: Alcoholic beverages will only be served to patrons who are not visibly intoxicated or impaired. We train our staff in responsible alcohol service practices per ABT guidelines, including refusal of service to prevent overconsumption. You agree not to encourage or assist others in violating these rules. Overconsumption may lead to immediate removal and denial of future entry.
- Prohibition on Outside Alcohol: No outside alcoholic beverages are permitted on the premises. Violations may result in confiscation, removal, and additional fees to cover any related costs.
Failure to comply with these age and service restrictions may result in civil or criminal liability, and you agree to indemnify us against any claims arising from your violations.
2. Conduct and Behavior Standards
To ensure a safe, enjoyable environment for all guests, you agree to conduct yourself in a respectful and lawful manner while using our Services or on our premises. Prohibited conduct includes, but is not limited to:
- Harassment, discrimination, or any form of unwanted physical, verbal, or sexual contact toward staff, performers, or other patrons.
- Excessive noise, disruptive behavior, or interference with others' enjoyment.
- Use, possession, or distribution of illegal drugs, controlled substances, or any items prohibited by Florida law (e.g., firearms, weapons, explosives).
- Smoking or vaping in non-designated areas, in violation of Florida's Clean Indoor Air Act (Florida Statute § 386.201 et seq.).
- Damaging property, tampering with equipment, or engaging in theft.
- Solicitation, unauthorized commercial activity, or distribution of flyers/marketing materials without prior written consent.
- Recording or photographing staff, performers, or other patrons without explicit consent, except for personal use in public areas.
We promote an inclusive environment free from discrimination based on race, color, religion, sex, national origin, age, disability, or any other protected characteristic under Florida and federal law. Violations of these standards may result in warnings, temporary suspension of access, or permanent bans.
3. Right to Refuse Service and Removal
One K reserves the absolute right, in our sole discretion, to refuse service to any person, deny entry, or remove any individual from our premises at any time, for any reason or no reason, without notice or liability. This includes, but is not limited to:
- Suspicion of underage entry or alcohol consumption.
- Signs of intoxication, overconsumption, or impairment that could endanger yourself or others.
- Violation of these Terms, house policies, or applicable laws.
- Behavior deemed disruptive, unsafe, or incompatible with our venue's atmosphere.
- Failure to comply with staff instructions, including health and safety protocols (e.g., mask requirements during health emergencies, if applicable).
In the event of removal, you agree to leave the premises peacefully and without incident. We may involve law enforcement if necessary, and you will be responsible for any associated costs, including damages, legal fees, or fines. No refunds will be issued for reservations, tickets, or purchases in such cases.
4. Reservations, Events, and Tickets
- Bookings: Reservations and event tickets may be made via our website, third-party platforms (e.g., Eventbrite, Posh), or by contacting us at info@onekmiami.com. All bookings are subject to availability and confirmation. You must provide accurate information and agree to these Terms at the time of booking.
- Cancellations and No-Shows: Cancellations must be made at least 24 hours in advance for standard reservations; shorter notice may incur fees up to the full reservation amount. Private events require 7 days' notice, or full payment may be due. No-shows are charged the full amount and may result in future booking restrictions.
- Group Policies: For groups of 6 or more, a credit card hold may be required for potential damages or minimum spends. Guest lists are at our discretion and may be modified for capacity or safety reasons.
- Event Changes: We reserve the right to alter, postpone, or cancel events due to unforeseen circumstances (e.g., weather, emergencies, low attendance). In such cases, we will provide notice where possible and offer refunds or credits at our discretion. You agree that we are not liable for any incidental costs (e.g., travel expenses).
- Tickets: All ticket sales are final and non-transferable unless specified. Resale above face value is prohibited.
5. Payments and Fees
All payments are processed securely via our website or third-party providers. You authorize charges for reservations, events, purchases, and any incidental fees (e.g., damages, cover charges). Prices are subject to change without notice, excluding confirmed bookings. We are not responsible for transaction errors; contact your payment provider for disputes.
6. Liability Limitations and Disclaimers
To the fullest extent permitted by law, One K, its owners, employees, and affiliates disclaim all liability for:
- Personal injuries, property damage, or losses arising from your use of our Services or premises, except in cases of our gross negligence or willful misconduct. You assume all risks associated with alcohol consumption, including impairment-related accidents.
- Third-party actions, including those of other patrons, performers, or vendors.
- Indirect, consequential, or punitive damages, even if advised of the possibility.
- Force majeure events (e.g., acts of God, pandemics, strikes).
Florida law limits dram shop liability (Florida Statute § 768.125), but you agree to release us from claims related to alcohol service, provided we act responsibly. By entering our premises, you waive any right to sue for ordinary negligence in alcohol-related incidents. This is a recreational activity venue; participants assume inherent risks.
We maintain general liability insurance, but it does not cover your personal belongings—use at your own risk. Valet or coat check services, if offered, are courtesy only and not insured by us.
7. Health and Safety
You agree to comply with all applicable health and safety laws, including COVID-19 or other protocols. We may require proof of vaccination, temperature checks, or other measures. Refusal may result in denial of entry. Report any hazards or incidents to staff immediately.
8. Intellectual Property
All content on our website, including logos, images, and event details, is owned by One K or licensed to us. You may not reproduce, distribute, or use it commercially without written permission. User-submitted content (e.g., reviews) grants us a non-exclusive, royalty-free license to use for promotional purposes.
9. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Florida, without regard to conflict of laws principles. Any disputes shall be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida. You waive any right to class actions or jury trials. Prevailing party in any litigation recovers reasonable attorneys' fees.
10. Miscellaneous
- Severability: If any provision is held invalid, the remainder remains enforceable.
- Entire Agreement: These Terms constitute the full agreement, superseding prior understandings.
- Assignment: We may assign these Terms; you may not without our consent.
- Waiver: No waiver of any breach is a waiver of subsequent breaches.
